TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Lineup Technology Services Pvt. Ltd. (“LineupX”), including our website (www.lineupx.com), mobile application, and associated tools and features (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must refrain from using the Service.

1. Amendments to the Terms

LineupX reserves the right to modify or update these Terms at any time at our sole discretion. Significant changes will be communicated via the Service, by email, or through app notifications. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

2. Eligibility and Account Registration

To access certain features, you may be required to register for an account.

• Students: You must be at least 16 years of age. If you are under 16, parental or guardian consent is required via a consent form available on LineupX website.

• Professionals/Employers: You must be at least 18 years of age to create and operate an individual or business account.

You agree to provide accurate, complete, and updated information during registration and to maintain the confidentiality of your account credentials. You are solely responsible for all activities that occur under your account.

3. User Content

You may submit content including, but not limited to, resumes, profiles, messages, and job postings ("User Content"). You retain ownership of your User Content; however, by submitting it to LineupX, you grant LineupX a worldwide, royalty-free, non-exclusive, transferable license to use, reproduce, modify, publish, distribute, and display such content solely for the operation and improvement of the Service.

You are solely responsible for the legality, reliability, and accuracy of your User Content. LineupX reserves the right to remove or disable access to any content that violates these Terms or applicable laws.

4. Intellectual Property Rights

All content, trademarks, service marks, software, logos, designs, and intellectual property not submitted by users ("LineupX Content") are the exclusive property of LineupX or its licensors and are protected under applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, or create derivative works based on LineupX Content without our prior written consent. The name “LineupX” and associated logos are our registered or unregistered trademarks and may not be used without authorization.

5. Use of AI and Machine Learning

LineupX leverages artificial intelligence and machine learning technologies to enhance its services, including personalized job matching. Data and information you provide (“Submissions”) may be used to train internal AI systems. You retain ownership of your Submissions; however, any AI-generated outputs (“Generated Responses”) derived from our models are the intellectual property of LineupX.

You may use Generated Responses solely in accordance with these Terms. Do not include sensitive personal data unless it is essential for the service’s functionality.

6. Third-Party Services and Links

The Service may contain links to third-party websites, applications, or services. These are provided solely for your convenience. LineupX does not control and is not responsible for the content, privacy policies, or practices of any third-party sites or services. Your use of such services is at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, LineupX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

LineupX’s total liability for any claims arising out of or relating to these Terms or the Service shall not exceed INR 1,000 (Indian Rupees One Thousand only).

8. Indemnification

You agree to indemnify, defend, and hold harmless LineupX, its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in connection with:

• Your use or misuse of the Service;

• Your User Content;

• Your violation of these Terms or applicable laws.

9. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms shall be subject to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat and venue of arbitration in Mumbai, India, and the proceedings conducted in English.

Before initiating arbitration, the parties shall attempt to resolve the dispute amicably by contacting support@lineupx.com within a period of 15 days.

10. Termination

LineupX may suspend or permanently terminate your access to the Service at any time and without prior notice if you violate these Terms or engage in conduct that LineupX deems harmful to the Service, other users, or LineupX’s business interests.

11. Privacy Policy

LineupX Privacy Policy, available at www.lineupx.com/privacy-policy, explains how we collect, use, and safeguard your personal data. By using the Service, you agree to the collection and use of information in accordance with LineupX’s Privacy Policy.

12. General Provisions

• Entire Agreement: These Terms constitute the complete agreement between you and LineupX and supersede any prior agreements or understandings.

• Severability: If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

• Waiver: Failure by LineupX to enforce any provision of these Terms shall not be construed as a waiver of our rights.

• Assignment: LineupX may assign or transfer these Terms, in whole or in part, without restriction. You may not assign these Terms without prior written consent.
